心理咨询是灵丹妙药吗

爱自己,不仅要关注自己的生理健康,也要关注自己的心理健康。

现在这个时代,随着物质的丰盈,大家越来越关注自己的精神健康,在有心理困扰的时候也知道寻求心理咨询的帮助。大家对心理咨询的接受度越来越广,但是也存在很多误解。

今天带大家来了解常见的两个误区,希望大家能对心理咨询形成正确的认识。
误区一:有病的人才做心理咨询

“正常人谁做心理咨询啊?”
“TA竟然去做心理咨询?是不是有精神病啊?快离TA远点……”
你是否对心理咨询有这样的偏见呢?

其实,向专业的心理咨询师求助的这种行动也是在打破心理咨询的污名化。求助是一种很值得称赞的行为,也是一种能力。

心理咨询的对象恰恰是针对正常人群,或者是正在恢复的病人。关注的问题与工作生活息息相关,比如社交人际、工作压力、职业发展、婚姻情感、亲子教育等。心理咨询对于抑郁症、焦虑症等心理疾病也有一定的帮助,但是严重到一定程度,还是需要去相关医院诊断,并根据医嘱服用药物。



很多人是对心理问题或心理疾病是存在偏见的。或是觉得自己心理有问题会受到歧视,宁愿自己身体出毛病也不愿意心理有困扰;或是对别人存在心理困扰有偏见,“TA有病,生人勿进”。

其实,不就是有困扰吗?不就是有病吗?有什么大不了呢?

我们会对很多生理疾病不避讳。有些人住个医院或者打个吊瓶还要发个朋友圈求安慰求关心,但对心理问题却讳莫如深。

一个人的健康分为生理健康和心理健康,二者相辅相成,缺一不可。我们会对生理健康非常重视,但对心理健康抱有一种“禁忌”的意味,不能多言。心理层面的问题更多的是内隐的,自己不想发觉,别人很难发现。

我们为什么对生理层面的问题这么重视呢?

一方面是因为目前的生理医学比较发达,大家对一些生理疾病越来越了解。另一方面是这些生理问题也容易被外人看见,容易被外人重视。当你鼻塞了、脚摔断了,别人很容易看见。



但是当你心理焦虑、情绪低落、内心的苦闷无法排解时,如果自己不说出来并假装无事发生,别人很难发现。

所以,需要我们先接纳自己,在需要帮助的时候主动求助。其次,我们需要给有心理困扰的人一些关爱和包容。丢掉唏嘘和冷眼,丢掉偏见和歧视,对自己,也对别人

误区二:一次就要帮我解决问题

“怎么老是让我说,你不是老师吗?还不明白吗?”
“一次不能解决问题吗?怎么还要好几次?怎么这么麻烦!”

遇到问题想要快速解决,想要快速脱离这种痛苦的状态是可以理解的。但是很多人心存幻想,想要一次性解决所有问题,这样的可能性很小。

就像身体出问题去看医生一样,简单的头痛感冒可能一次去了拿点药就好了,严重的就要挂好几次吊瓶。如果是骨折这种大问题住院不说,还需要去复查好多次。

生理上的痛苦要去好多次医院才能剥离,心理上的困扰也不例外。冰冻三尺,非一日之寒;滴水石穿,非一日之功。问题也不是一日积淀而成的,妄想一次解决只会徒增暴躁,问题也是要慢慢解决的。



那么,心理咨询要做几次才能见效呢?

这种事情很难有结结实实的定论。可能你第一次做咨询,能够倾诉内心挤压已久的不快,被接纳、被包容,能够感觉到自己“好些了”;可能你要经过3-5次,你才会觉得自己有所收获。具体情况具体分析,改善程度也与自己的问题严重程度、个人特质、改善意愿等因素有关。

有心理困扰无需羞耻,心理咨询也不是灵丹妙药像接纳生理问题一样接纳心理问题,让本该平常的事情平常化。

    欢迎使用中智EAP服务。

    1.协议说明
    本用户服务协议(下称“本协议”)是由用户(下称“用户”或者“您”)与中智关爱通(下称“我们”)共同缔结,是用户注册登录答心平台账号并使用我们中智EAP服务时的通用条款。
    为维护您使用服务时的合法权益,请您务必审慎阅读、充分理解各个条款内容,特别是以加粗形式提示您注意的条款。您有权选择同意或不同意本协议,但当您勾选“已阅读并同意”并完成【注册登录】后,即视为您已充分阅读、理解本协议,自愿受本协议的约束。您在阅读本协议过程中,如果您不同意本协议或其他任意条款,请立即停止登录并停止使用我们的服务,否则将视为您已经完全接受本协议的全部内容。

    2.定义
    中智关爱通:指中智关爱通(上海)科技股份有限公司。
    本平台:本平台包含答心平台、7x24小时热线以及与我们的咨询师面对面咨询。
    本协议:指用户服务协议。
    中智EAP企业用户:指注册、登录、使用中智EAP服务的个人或组织,包括但不限于法人(如公司、政府机构、事业单位等)、非法人组织(如合伙企业等)、个体工商户等。(又称“中智EAP企业用户”、“您所在的企业用户”或“您的企业”);中智EAP企业用户可以邀请并授权个人用户成为我们的最终用户。
    个人用户/最终用户:指受中智EAP企业用户邀请注册使用我们服务的个人用户,以下称“您”或“个人用户”。
    前述“中智EAP企业用户”及“最终用户”统称为“用户”或“所有用户”。

    3.注册与用户行为规范
    3.1一般来说,当您所在的企业用户在向最终用户分配最终用户账号时,为验证最终用户所属组织,并获得提供服务所必要的用户信息,最终用户需通过手机号码或邮箱验证后方能使用个人账号。或当您所在的企业用户选择由最终用户自主注册个人账号时,中智EAP将通过发送短信验证码的方式来验证您的身份是否可提供服务。中智EAP有权根据用户需求或产品需要对账号注册方式进行变更。
    3.2用户注册登录时,应当按照法律法规和服务要求,按相应页面的提示准确提供并及时更新用户的资料,以使之真实、及时,完整和准确,例如为了保证您的账户及个人信息安全保证手机号等内容的有效性及安全性,请您使用经过您本人实名认证的手机号,以便我们可以通过上述的手机号与用户取得联系。同时,用户也应对在接受服务过程中提供的所有信息的真实性负责,若相关信息发生变更,用户应及时更新相关注册信息。我们有权基于用户提交的注册信息中的手机号码等对用户进行真实身份信息核验与认证,如发现用户的注册信息违反本条约定的,我们有权拒绝提供服务,并注销该账号。用户承诺不得冒充他人进行注册,不得未经许可为他人注册,不得以可能误导其他用户的方式注册账号,不得使用可能侵犯他人权益的用户名进行注册(包括但不限于涉嫌商标权、名誉权侵权等),在账号昵称、头像和填写的其他注册或预约信息中不得出现违法和不良信息,否则我们有权拒绝提供服务,并注销该账号。
    3.3用户确认,在用户完成注册程序或以其它我们允许的方式实际使用服务时,用户应该是具备完全民事权利能力和与所从事的民事行为相适应的行为能力的自然人、法人或其他组织。若用户不具备前述主体资格,请在法定监护人的陪同下阅读和判断是否同意本协议,并由用户及用户的法定监护人承担因此而导致的一切后果,且我们有权注销(永久冻结)用户的账户,给我们造成损失的,我们有权向用户追偿。
    3.4用户完成申请注册后,仅获得本平台账号的使用权,用户不得赠与、借用、租用、转让或售卖本平台账号或者以其他方式许可他人使用。如果用户违反上诉规定,我们有权拒绝提供服务,并追究其法律责任。
    3.5用户注册成功后,可通过注册的账户信息及密码随时登录本平台。用户有责任妥善保管注册账户信息及账户密码的安全,如果因用户未保管好自己的本平台账号和密码而对用户自身、本平台、其他用户或第三方造成的损害,将由用户承担全部责任,用户要对其拥有的账号进行的所有活动及发生的所有事件负全责。用户若发现任何非法使用账号或安全漏洞的情况,请及时告知本平台。
    3.6用户应对自身账户下的行为承担法律责任。用户须遵守国家关于互联网信息发布的相关法律法规,并对自己在本平台上发布的信息及行为承担责任。用户不得发布违法信息,不得恶意评价其他用户、不得对平台内其他用户进行恶意骚扰、侮辱、人身攻击等行为。如您因违反上述规则,导致相应法律后果的发生,您将以自己的名义独立承担所有法律责任,以及接受我们对您采取的相应措施。
    您同意独自就您在使用服务时发布、传送或展示的任何内容以及您做出该等行为的后果(包括本平台可能遭受的任何损失或损害)承担责任(本平台不对您或任何第三方承担责任)。
    3.7用户在完成注册后,可使用的服务类型取决于您所在的企业用户采购的产品/服务,根据您所在的企业用户的采购需求,在本平台上享受已采购的文章阅读、心理课堂、听书推荐、正念冥想等相关服务,具体咨询服务的类型/次数以您所在的企业用户实际采购为准。
    3.8一位个人用户仅限使用一个账号,凡存在不当注册或不当使用多个账号的,本平台有权注销多余账号并视情况拒绝提供服务,因使用多个账号而对用户本人、本平台、您所在的企业用户或第三方造成的损害,将由用户承担全部责任。
    3.9用户承诺不对本平台任何资料作商业性利用,不能利用本平台各项服务进行销售或其它商业用途,否则对本平台造成的损失,应由用户承担全部赔偿责任。
    3.10用户使用本平台任何服务,除现行的法律法规相关规定之外,本平台不承担由于用户自身过错、技术或其它不可抗力原因导致的应用页面信息或其它方面的错误而给用户造成的损失。
    3.11用户同意如果本平台因为以上用户规则禁用/冻结/删除/注销了您的注册账号,则您可能会被阻止获得服务、或您将会被拒绝访问您的账户资料或包含在您账户中的任何文件内容。

    4.本平台的权利和责任
    4.1本平台有义务对文章阅读、心理课堂、听书推荐、正念冥想等内容进行定期维护与更新,增强用户使用服务的体验。对用户在注册使用服务中所遇到的与服务或注册有关的问题及反映的情况,本平台有义务及时作出回应。
    4.2本平台没有义务对所有用户的注册数据、所有的活动行为以及与之有关的其它事项进行审查,但如存在下列情况,本平台有权根据不同情况选择保留或删除相关信息或继续、停止对该用户提供服务,并追究相关法律责任:您或其它第三方通知本平台,认为某个具体用户、具体行为、具体事项可能存在侵犯他人权益的;
    (1)您或其它第三方向本平台告知可能存在违法犯罪或不当行为的,本平台以普通非专业人员的知识水平标准对相关内容进行判别,可以明显认为这些内容或行为具有违法或不当性质的。
    (2)如您和咨询师未通过本平台或我们其他官方渠道进行咨询预约及进行后续咨询,由此产生的任何纠纷属于您与咨询师的私人纠纷,我们不承担任何责任。如本平台发现您和咨询师存在私下交易的行为,可即时采取注销账户并拒绝提供服务措施,如给我们及其相关方造成损失的,您和咨询师还应承担相应赔偿责任。
    4.3中智关爱通拥有平台内的所有产品、技术、程序、资料、信息内容(包括但不限于文字、图片、图像、照片、音频、视频、图表、色彩、版面设计、电子文档)的所有权利或合法使用权利(包括但不限于著作权、商标权、专利权、商业秘密及其他所有相关权利),未经我们同意,用户不得进行复制、出租、修改、转载、汇编、发表、出版等涉及侵犯知识产权的行为。
    4.4中智关爱通有权对用户的注册数据及活动行为进行查阅,发现注册数据或活动行为中存在任何问题或怀疑,中智关爱通均有权向用户发出询问及要求改正的通知或者直接作出删除等处理。
    4.5中智关爱通致力于为用户提供文明健康、规范有序的服务,用户应遵守中华人民共和国相关法律法规,(如果用户是中华人民共和国境外的使用者,还应遵守所属国家或地区的法律法规),用户将自行承担用户所发布的信息内容的责任。如因用户的不当行为造成恶劣影响、损害他人合法权利等行为,我们有权对用户采取“相应措施”。

    5.使用咨询服务时的用户须知及免责条款
    为维护用户利益,保证本平台咨询服务的顺利进行,就相关服务的基本原则、用户的责任和义务做如下说明:
    5.1使用心理咨询服务时的用户须知
    5.1.1咨询保密原则:
    本平台对用户的个人信息及咨询的相关问题会严格保密,不被第三方知晓。但下述情况除外
    (1)用户出现自我伤害或伤害他人的倾向,紧急情况下为保护用户及他人生命健康和财产安全所必需的;
    (2)在获取用户同意的情况下;
    (3)为履行法定职责或者法定义务所必需;
    (4)在法律、法律程序或政府主管部门强制性要求时;
    (5)其它中智EAP《隐私政策》明确约定的例外情形。
    5.1.2咨询时长:一般情况下,个体咨询每次50分钟,这有助于咨询师和用户保持专注,进行高效深入的交流,固定的时间设置也有助于双方建立稳定的、安全的咨访关系,从而达到最佳的咨询效果。
    5.1.3咨询频率:一般情况下,咨询频率为一周一次,这样可以使用户有缓冲时间能进行自我思考和自我成长。
    5.1.4咨询回访:为了提升服务质量,咨询结束后本平台将会通过短信或人工电话的方式进行满意度回访。
    5.1.5咨访关系:咨访关系是一种特殊的、职业的、超脱一般人际关系的人与人的联结,咨询师与用户不是朋友,也不是师生,用户与咨询师建立咨访关系以外的任何其他关系都是不合适的,同时用户不允许通过任何途径赠送咨询师礼品,也不得在咨询服务之外与咨询师进行非必要交流。
    5.1.6咨询转介:如咨询师发现用户无法在咨询中受益,出于对用户的负责,咨询师会在征询用户的同意,把用户转介给其他咨询师或专业机构。
    5.1.7用户有权获知咨询师的相关专业背景,以决定接受或拒绝该咨询师服务。
    5.1.8用户有义务提供专业医疗机构作出的心理卫生或精神疾病相关诊断,不能隐瞒精神类相关病史。
    5.1.9咨询信息收集、存储及使用:为更好地服务用户,追踪、评估咨询的进展和效果,咨询师将在咨询结束后对咨询做简要记录,在严格保密的前提下使用和处理专业工作相关信息。
    5.1.10咨询督导:为提供高质量的服务,咨询师可能会申请个案督导及咨询商讨,但将会在严格专业的保密环境下进行,并隐去用户的可识别个人信息。
    5.1.11根据2021年1月1日起施行的《中华人民共和国民法典》(以下简称:民法典)关于未成年人的相关规定,结合《中华人民共和国精神卫生法》的隐私保密相关规定,未成年人咨询准则如下:
    年龄阶段8周岁以下8-18周岁
    民法典规定无民事行为能力人限制民事行为能力人
    咨询预约每次都必须由父母预约
    咨询陪同必须有监护陪同一起进行咨询可单独与咨询师进行咨询,面询需由监护人陪同前往咨询室。
    咨询内容透露孩子咨询内容不保密,无须告知父母保密协议咨询师需在咨询开始前就咨询内容保密性与监护人,孩子一起达成三方共识:
    1.为了咨询效果,孩子咨询的细节内容不向监护人透露,除非涉及到伤害自己或他人的行为或念头。
    2.咨询师和监护人沟通前,会和孩子确认哪些内容可以让监护人知道,并且获得同意。
    注:根据民法典规定,16-18岁(有劳动收入且有独立生活能力的未成年人),视为“完全民事行为能力人”,规则等同成年人。
    5.2咨询服务免责条款
    5.2.1心理咨询的局限性
    心理咨询是一个循序渐进的过程,一次咨询效果有限,无法解决您当前面临的所有困扰,您可以在过程中与咨询师反馈咨询期待和感受,共同探讨咨询目标。
    心理咨询的效果取决于心理咨询师和您的共同努力,心理咨询师可提供专业建议,但并不会代替您进行决策。您的最终决策所产生的结果需要用户自行承担,我们及咨询师不因此承担任何责任。
    同时,心理咨询是一个促使个人心灵成长的过程,心灵的成长过程可能也会带来一定的痛苦和不适的感受,请您在时间、心理等方面做好相应的准备。
    本平台及咨询师对服务结果不承担任何法律责任。
    5.2.2心理危机免责
    如果在咨询期间发现您可能会危害生命安全,咨询师会尽所能为您提供支持和帮助。但不能保证心理咨询与治疗期间用户的冲动会马上减缓,也不能保证其今后不再有自杀或伤害他人的行为与倾向。如您存在自杀自伤、他杀他伤等风险,您的亲属须承担看护责任,防止出现意外事故。如果您最终选择自杀或伤害他人,作为一个具备完全民事行为能力与刑事责任能力的自然人,您承担全部责任与行为后果,本平台及咨询师不承担任何连带民事或刑事责任。
    如果您在本平台进行咨询时有自杀或伤害他人的倾向与行为,我们或咨询师将会联系您所在的企业用户履行告知义务,当履行完告知义务后,我们及咨询师不承担其他责任。对由于您隐瞒诊断和症状造成的后果,我们及咨询师亦不承担责任。
    5.2.3推荐就医免责
    本平台及咨询师不提供精神疾病的诊断、治疗或医疗服务。经过咨询师的全面评估后,若发现您当前的困扰或症状已不属于心理咨询范畴,咨询师将建议您进行就医诊断和治疗,在遵医嘱服药或治疗的前提下,咨询师方可为您继续提供心理咨询服务。同时,请如实告知您在专业医疗机构作的心理卫生或精神疾病相关诊断,以让咨询师更好地理解您,获得更好的咨询效果。
    来访者因就医治疗而产生相关医疗纠纷,本平台及咨询师不承担任何责任。
    5.2.4纠纷投诉处置
    在心理咨询过程中,如您认为咨询师有违职业道德言行,不符合服务行业的通用法规规定,或者认为在咨询过程中存在问题或意见,可以发送邮件至daxin@guanaitong.com进行投诉。但严禁对咨询师进行言语诽谤或人身攻击,如有发生,本平台将追究其违规责任及法律责任。
    如因您故意隐瞒或提供虚假信息导致咨询的效果受到影响,本平台及咨询师将不承担任何责任。
    5.3使用即时咨询时的用户须知
    即时咨询是心理咨询的一种形式,以上的心理咨询用户须知及免责条款均适用于即时咨询。此外,用户在使用即时咨询时,请知晓以下说明:
    5.3.1即时咨询是一种方便、快捷的心理健康服务,当您有情绪又无处倾吐、当您在面临压力或困扰时,无需等待即可获得专业心理咨询师的支持和帮助。
    5.3.2即时咨询,不同于常规的心理咨询服务,通常为一次单元的咨访关系,即时咨询师非固定,每次咨询师可能不同。
    5.3.3即时咨询的专业设置
    (1)时长设置:一般情况下,即时咨询每次50分钟。
    (2)次数设置:即时咨询与预约咨询频率合计为每自然周一次,如您在本周使用了即时咨询将无法预约当周咨询,反之亦然。
    (3)服务时间:工作日10:00-17:00。
    (4)环境设置:请在一个安静且私密的环境中开启咨询,这将更有利于保护您的隐私、保障咨询效果,如所处环境会严重影响咨询效果,咨询师将会建议选择更适宜的环境和时间开展咨询。
    (5)套餐设置:即时咨询将会计入到您的企业咨询套餐使用中,如您的咨询套餐有次数限制,即时咨询与预约咨询相同,将扣除您的咨询使用次数。
    5.3.4如有以下情况,我们建议您预约结构化咨询服务,以便从咨询中获取更大益处。
    (1)您已经与某位咨询师建立了固定咨询关系;
    (2)您希望与咨询师就某一话题进行深入讨论:如抑郁症康复、青少年相关问题处理等;
    (3)如即时咨询师评估您需要更结构化的咨询,咨询师会在必要时征询您的同意,为您预约结构化咨询。
    5.3.5本服务将严格遵守国家相关法律规定来进行提供,同时,为保证服务质量,您的通话可能会被录音。
    5.4使用文字咨询时的用户须知
    5.4.1文字咨询是心理咨询的一种形式,以上的心理咨询用户须知及免责条款均适用于文字咨询。此外,用户在使用文字咨询时,请知晓以下说明:
    文字咨询,作为网络心理咨询服务的方式之一,是采取文本的方式,来访者与咨询师进行一对一沟通、对话的心理咨询。
    如果您不太习惯语音/视频/面对面咨询,或者有外界周围条件有影响的情况下,可以考虑先尝试纯文字方案。由于文字的信息承载量比较小,例如在文字沟通中,您这边可能花5分钟去整理一段文字,咨询师也会花5分钟去看这段话给你回复,效率一般。同时,由于损失了语音、语调、身体姿势等信息,因此,一般来说,电话/视频/面对面心理咨询的单次咨询效果会优于文字咨询。
    5.4.2文字咨询的专业设置
    (1)时长设置:文字咨询每次不超过50分钟。
    (2)服务时间:工作日10:00-17:00。
    (3)套餐设置:文字咨询将会计入到您的企业咨询套餐使用中,如您的咨询套餐有次数限制,文字咨询与电话/视频/面对面心理咨询相同,将扣除您的咨询使用次数。
    5.4.3如有以下情况,我们建议您预约结构化咨询服务,以便从咨询中获取更大益处。
    (1)您已经与某位咨询师建立了固定咨询关系。
    (2)您希望与咨询师就某一话题进行深入讨论:如抑郁症等心理疾病的康复、青少年相关问题处理等。
    5.4.4当你有伤害自己/他人的危险,我们将立刻电话联系您,请您保持电话畅通,同时,
    紧急情况下,我们也有责任联系您的紧急联系人或您所在的企业。
    5.5其他咨询服务的免责协议
    预约使用本平台的生理、法律、财务咨询,仅提供相关领域的知识科普或解读,生理咨询不提供诸如医学诊断治疗、开具处方等服务,法律咨询不提供法律文书的撰写或审阅、法律诉讼等服务,财务咨询不提供理财产品推荐等服务。
    用户拥有自主决定权,在医疗、法律、财务所做出的决定,与本平台的咨询服务无关,我们不承担因用户自主决定所产生的不良结果。
    6.服务变更、中断或终止
    6.1更新
    (1)为了改善用户体验、完善服务体系,本平台将不断努力开发新的服务或内容,并为用户不时提供更新。
    (2)鉴于互联网服务的特殊性,为了保证服务的安全性和功能的一致性,我们有权不经向用户特别通知而进行更新,或者对部分功能效果进行改变或限制。
    6.2服务中断或终止
    如发生下列任何一种情形,我们有权解除本协议,并终止用户的全部服务:
    (1)您所在的企业用户停止采购我们在本平台上的服务;
    (2)个人用户从您所在的企业用户离职;
    (3)用户违反国家有关法律法规或我们管理规定,侵害他人合法权益的;
    (4)用户因在本平台上的不当行为被行政或司法机构拘留或起诉;
    (5)用户盗用他人账户、发布违禁信息、骗取他人财物的;
    (6)用户传播虚假信息,歪曲事实,经查证属实的;
    (7)用户骚扰、侮辱平台其他用户,造成恶劣影响的;
    (8)其它违反本协议第一条注册与用户行为规范或其他我们认为需要终止服务的情况。
    (9)除前款所述情形外,我们保留在不事先通知用户的情况下随时中断或终止部分或全部网络服务的权利,对于服务的中断或终止而造成用户的损失的,我们不承担任何责任。
    6.3服务发生变更、中断、终止后,我们仍有以下权利:
    (1)我们有权保留用户的注册数据及以前的行为记录;
    (2)如您在服务变更、中断、终止前,在我们平台上存在违法行为或违反条款的行为,我们仍可行使本服务条款所规定的权利。

    7.2信息保密
    您的隐私是我们最关心的问题。我们不会对外公开或向第三方提供您的个人信息及您在使用服务时存储的非公开内容,但下列情况除外:事先获得您的明确授权;向您或您所在的企业用户提供我们服务所必需;为履行法定职责或者法定义务所必需;为应对突发公共卫生事件或者紧急情况下为保护自然人的生命健康和财产安全所必需;从合法公开披露的信息中收集个人信息的;为了向您提供更完善、优质的产品/服务,与第三方共享。

    8.有限责任
    除法律另有规定以外,我们不对由于网络连接故障,设备故障,电脑,通讯或其他系统的故障,电力故障,黑客攻击或网络攻击,罢工,劳动争议,暴乱,起义,骚乱,生产力或生产资料不足,火灾,洪水,风暴,爆炸,战争,政府行为,国际、国内法院的命令或第三方的不作为而造成的不能服务或延迟服务、数据丢失、系统故障承担责任。不论是否可以预见,不论是源于何种形式的行为,我们不对间接的损害(包括但不限于利润或利息的损失,营业中止)承担责任。

    9.违约责任
    9.1如果我们发现您有下列任一行为的,有权根据相应本协议的规定,采取“相应措施”。
    您在此承诺我们有权作出上述行为,并承诺不就下列行为要求我们做任何补偿或要求我们向贵公司进行赔偿:
    (1)您提供虚假注册信息;
    (2)您违反本协议中规定的使用规则;
    (3)通过非法手段、不正当手段或其他不公平的手段使用我们的产品和服务或参与本平台活动;
    (4)有损害本平台正当利益的行为;
    (5)有严重损害其他用户的行为;
    (6)有违反中华人民共和国的法律、法规的行为或言论;
    (7)有违背社会风俗、社会道德和互联网一般道德和礼仪的行为;
    (8)其他妨碍本平台提供服务或我们认为的严重不当行为。
    同一用户若存在上述任一行为的,我们有权对该用户下的所有账号予以处理,所采取的“相应措施”包括但不限于以下一项或多项:
    (1)更改、删除或屏蔽相关内容;
    (2)警告违规账号、账号禁言;
    (3)变更、限制或禁止违规账号部分或全部功能;
    (4)暂停、限制或终止用户使用本平台服务的权利、注销用户账号等;
    (5)向有关监管部门或国家机关报告;
    (6)其他受损失的第三人认为合理的措施。
    9.2您同意保障和维护本平台及其他用户的利益,如因您违反有关法律、法规或本协议项下的任何条款而给本平台或任何其他第三人造成损失,您同意承担由此造成的损害赔偿责任。

    10.服务条款修改
    10.1用户使用平台即视为用户已阅读并同意受本协议的约束。我们有权在必要时修改本协议条款。我们可能会以包括但不限于在相关服务页面展示、网页公告、网页提示、电子邮箱、手机短信、常规的信件传送、用户注册使用本服务的账号管理系统内发送站内信等方式中的一种或多种,向用户送达关于本服务的各种规则、通知、提示等信息或本协议修改内容。
    10.2本协议条款变更后,如果用户不接受修改后的协议,应当停止使用本平台的服务。如果您继续使用平台服务,则视为您已接受修改后的协议。

    11.争议解决
    11.1本协议签订地为中华人民共和国上海市徐汇区。
    11.2本协议的解释与适用,以及与本协议有关的争议,均应适用中华人民共和国法律法规予以处理,并排除任何冲突法的适用,并以本协议签订地有管辖权的人民法院管辖

    12.通知送达
    本协议项下我们对于您所有的通知均可通过网页公告、电子邮件、手机短信、微信消息或常规的信件传送等方式进行;该等通知于发送之日视为已送达给您。

    13.其他规定
    13.1本服务条款构成您与我们对服务条款之约定事项及其他有关事宜的完整协议,除服务条款规定的之外,未赋予服务条款各方其他权利。
    13.2如本服务条款中的任何条款无论因何种原因完全或部分无效或不具有执行力,本条款的其余条款仍应有效并且有约束力。
    13.3本服务条款中的标题仅为方便而设,在解释本条款时应被忽略。

    User Service Agreement


    Welcome to CIIC EAP.

    1.Agreement Description
    This User Service Agreement(hereinafter referred to as"this Agreement")is entered into by and between the user(hereinafter referred to as"user"or"you")and CIIC Guanaitong(Shanghai)Technology Co.,Ltd.(hereinafter referred to as"We").It is a general term for users to register a Daxin account and use CIIC EAP services.

    In order to safeguard your legitimate rights and interests when using the service,please carefully read and fully understand the contents of each clause,especially the terms that are highlighted in bold.You have the right to choose to agree or disagree with this agreement,but when you check"read and agree"and click[register login],it is deemed that you have fully read and understood this agreement,and voluntarily accept the constraints of this agreement.If you do not agree to this agreement or any other terms during the process of reading this agreement,please stop logging in immediately and stop using the CIIC EAP service.Otherwise,it will be deemed that you have fully accepted all the contents of this agreement.

    2.Definition
    CIIC Guanaitong:refers to CIIC Guanaitong(Shanghai)Technology Co.,Ltd.
    This platform:refers to the application platform,including the"Daxin"platform,the 7*24 hotline service,meeting with a Provider,etc.
    This Agreement:refers to the User Service Agreement.
    CIIC EAP Sponsor:refers to individuals or organizations who register,log in,and use this product and service,including but not limited to legal entities(such as companies,government entities,public institutions,etc.),non-legal entities(such as partnerships,etc.),individual industrial and commercial households(also known as"CIIC EAP Sponsor","the enterprise you have joined"or"your enterprise"),enterprise users can invite and authorize individual users to become our end users.
    Individual User/End User:refers to the individual user invited by the enterprise user to register and use our service,hereinafter referred to as"you"or"individual user".The aforementioned"enterprise users"and"end users"are collectively referred to as"users"or"all users".

    3.Registration and User Code of Conduct
    a)Generally,when an enterprise user allocates an account to an end user,in order to verify the end user's organization and obtain the necessary user information to provide services, the end user needs to verify through the mobile phone number and email before using the personal account. Or, when an enterprise user chooses to let the end user register a personal account independently, CIIC EAP will verify your identity to check whether the services can be provided by sending a SMS verification code. CIIC EAP has the right to change the account registration method according to the user's needs or product needs.

    b)When registering,users should accurately provide and timely update their information according to the prompts on the corresponding page in accordance with laws,regulations and service requirements,so as to make it true,timely,complete and accurate.For example,in order to ensure the security of your account and personal information and the validity and security of mobile phone numbers and other contents,please use a mobile phone number that has been authenticated by your real name,so that we can contact users through the mobile phone number.At the same time,users should also be responsible for the authenticity of all information provided during the service process.If the relevant information changes,users should timely update the relevant registration information.We has the right to verify and authenticate the user's identity information based on the mobile phone number in the registration information submitted by the user. If it is found that the user's registration information violates these rules,we has the right to refuse to provide services and cancel the account.
    The user promises not to impersonate others for registration,not to register for others without permission,not to register accounts in a way that may mislead other users,and not to use usernames that may infringe on the rights of others for registration(including but not limited to suspected infringement of trade mark rights,reputation rights,etc.).The account nickname,avatar and other registration or appointment information shall not appear illegal or contain negative information.Otherwise,we has the right to refuse to provide services,and cancel the account.
    c)The user confirms that when the user completes the registration process or actually uses the service in other ways permitted by CIIC EAP,the user should have full capacity for civil rights and the capacity for civil conduct that is appropriate for the civil conduct engaged in natural person,legal person or other organization.If the user does not have the aforementioned qualifications,please be accompanied by a legal guardian to read and judge whether to agree to this agreement,and the user and the user's legal guardian shall bear all the consequences caused. Also, we has the right to cancel (permanently freeze) the user's account.If it causes losses to CIIC EAP,we has the right to ask for indemnity from the user.

    d)After the user completes the application and registration,he/she only obtains the right to use this platform’s account.The user shall not gift,borrow,rent,transfer or sell this platform’s account or license others to use it in any other way.If the user violates above rules,we have the right to refuse to provide services and pursue its legal responsibility.

    e)After the user registers successfully,he/she can log in this platform at any time through the registered account information and password.The user is responsible for keeping the registered account information and account password safe.The user will bear full responsibility if the user fails to keep his/her account and password safe,and causes damage to himself/herself,this platform,other users or third parties.The user shall be fully responsible for all activities and events of the account he/she owns.If the user finds any illegal use of the account or security bugs,please inform this platform in time.

    f)Users shall bear legal responsibility for their actions under their own accounts.Users must comply with relevant national laws and regulations on internet information release,and take responsibility for the information post and behaviors conducted on this platform.Users are not allowed to post illegal information,maliciously evaluate other users,or engage in malicious harassment,insult,personal attacks,and other inappropriate behaviors towards other users on the platform.If you violate the above rules and cause corresponding legal consequences,you will independently bear all legal responsibilities in your own name and accept the corresponding measures taken by CIIC EAP against you.
    You agree to be solely responsible for any content you post,transmit,or display while using the service and the consequences of your actions(including any loss or damage that the platform may suffer)(the platform is not responsible to you or any third party).


    g)After completing the registration,the type of services that users can use depends on the products/services purchased by the enterprise users in your location.According to the procurement needs of the enterprise users,you can enjoy the services such as article reading,course learning,audiobooks,mindfulness meditation and other related services that have already been purchased by the enterprise users from CIIC EAP on this platform,and the type/number of specific counseling services shall be subject to the actual procurement by the enterprise users.

    h)An individual user can only use one account.If there is improper registration or improper use of multiple accounts,this platform has the right to cancel the excess accounts and refuse to provide services as appropriate.The user shall be fully responsible for any damage caused by the enterprise user or a third party.

    i)The user promises not to use any information on this platform for commercial purposes,and cannot use the services of this platform for sales or other commercial purposes.Otherwise,the user shall bear full compensation responsibility for any losses caused to this platform.

    j)When users use any service of this platform,in addition to the relevant provisions of current laws and regulations,this platform shall not be liable for any losses caused to users due to errors in application page information or other aspects caused by their own faults,technology or other force majeure reasons.

    k)The user agrees that if this platform disables/freezes/deletes/cancels your registered account due to the above user rules,you may be blocked from obtaining services,or you will be denied access to your account information or any file contents contained in your account.

    4.Rights and responsibilities for this platform
    4.1 This platform has the obligation to regularly maintain and update the content on the platform,including articles,courses,assessments and other contents to enhance the user's experience of using the service. This platform has the obligation to respond in a timely manner to any problems or reflections encountered by users during the registration and use of the service.

    4.2 This platform is not obligated to review the registration data, all activities, and other matters related to all users, but if the following situations exist, this platform has the right to choose to retain or delete relevant information or continue, stop providing services to the user and pursue relevant legal responsibilities:

    ① If you or any other third party notifies this platform that you believe that a specific user, specific behavior, or specific matter may infringe on the rights of others.

    If you or other third parties inform this platform that there may be illegal or improper behaviors and it can be clearly believed that these contents or behaviors have illegal or improper nature by judging the relevant contents based on the knowledge level standards of ordinary non-professional by the platform.

    4.3 If users and counselors do not make counseling appointments and do not conduct follow-up counselings through this platform or other official channels of CIIC EAP, any disputes arising from this belong to your private disputes with the counselor, and we do not assume any responsibility.
    If this platform discovers any private transactions not permitted under the CIIC EAP Services between you and the counselor, it can immediately cancel your account and refuse to provide services. If it causes losses to CIIC EAP and its related parties, you and the counselor should also bear corresponding compensation responsibilities.


    4.4 We own the ownership or legal use rights (including but not limited to copyrights, trademarks, patents, trade secrets, and other related rights) of all the products,technologies, programs, materials, and information/ contents (including but not limited to texts, pictures, images, photos, audio, video, charts, colors, layout design, andelectronic documents) on the platform. Without the consent of CIIC EAP, users are not allowed to copy, rent, modify, reprint, compile, publish, or engage in any infringement ofintellectual property rights.
    4.5 CIIC Guanaitong has the right to access the user's registration data and activity behaviors.If there are any problems or doubts found in the user's registration data andactivity behaviors, CIIC Guanaitong has the right to send users inquiries and requests for correction notices or directly make deletions, etc.

    4.6 CIIC Guanaitong is committed to providing users with civilized, healthy, standardized and orderly services. Users should abide by relevant laws and regulations of the People's Republic of China(if the user is a user outside the People's Republic of China, they should also abide by the laws and regulations of the country or region to which they belong). Users will bear the responsibility for the information posted by themselves. If the user's improper behavior causes adverse effects or damages the legitimate rights and interests of others,we have the right to take"corresponding measures"against users.

    5.User notices and disclaimers when using psychological counseling services
    To protect users’interests and ensure counseling services run smoothly,the basic principles,responsibilities,and obligations of relevant services are explained as follows:
    5.1 User instructions when using psychological counseling services
    ①Counseling confidentiality principle:
    The user's personal information and counseling related issues will be kept strictly confidential by this platform and will not be known by third parties.However, the following situations are excluded:
    a. The user has a tendency to self-harm or harm others, which is necessary to protect the user's life,health,and property safety in emergency situations.
    b.With the user's consent.
    c. Necessary for fulfilling legal duties or obligations.
    d. When required by law, legal procedures or government authorities.
    e. Other exceptions expressly agreed in the "Privacy Policy".

    ② Time limits: In general, individual counseling lasts 50 minutes each time. The time limit helps to establish an effective and stable counseling relationship, so as to achievethe best counseling effect.

    Counseling frequency: In general, the counseling frequency is once a week, which can give users buffer time for self-reflection and self-growth.

    ④ Counseling effect follow-up: This platform will send you a satisfaction survey by SMS or manual phone call after your counseling session, in order to improve the quality ofservice.

    Relationship limitation: The counseling relationship is a special and professional relationship which is different from other common relationships. It is notfriendship or teacher-student relationship. It is not allowed for users to establish any relationship with counselors other than a counseling relationship. At the same time,users are not allowed to give gifts to counselors through any means, nor are they allowed to have unnecessary communication with counselors outside of counseling services.

    ⑥ If the counselor finds that the user cannot benefit from the counseling, out of responsibility to the user, the counselor will seek the user's consent and refer the user to other counselors or professional organizations.

    ⑦Users have the right to know the relevant professional background of the counselor to decide whether to accept or refuse the counselor's services.

    ⑧ The user has the obligation to provide diagnoses related to mental health or mental illness made by professional medical institutions, and cannot conceal any medicalhistories related to mental illness.

    ⑨ Counseling information collection, storage and use: In order to better serve the user, track and evaluate the progress as well as the effectiveness of the counseling, thecounselors will make a brief record of the counseling at the end of the session. The use and dispose of the information related to the professional work will be under thepremise of strict confidentiality.

    ⑩ Counseling supervision: In order to serve clients better, counselors may apply for case supervision and counsultation. It will be conducted in a strictly professional andconfidential environment, and clients'identifiable personal information will be hidden.

    ⑪According to the relevant provisions of the Civil Code of the People's Republic of China (hereinafter referred to as the Civil Code) on juveniles, which came into effect onJanuary 1, 2021, and in conjunction with the privacy and confidentiality-related provisions of the Mental Health Law of the People's Republic of China,the guidelines for counseling juvenile are as follows:

    Counseling AppointmentsParents must make an appointment for the client every time.
    Counseling AccompanimentClients must be accompanied by a guardian for counseling.The content of juvenile counseling is not confidential,and parents do not need to be informed of the confidentiality agreement.
    Disclosure of Counseling ContentClients could counsel with the counselor individually,but for face-to-face counseling,clients must be accompanied by a guardian to the counseling room.The counselor must make an agreement with both the guardian and the juvenile about confidentiality before the start of the session:
    1.The details of the juvenile's counseling content will not be disclosed to the guardian for the effectiveness of counseling unless it involves behavior or thoughts of harming oneself or others.
    2. Before the counselor communicates with the guardian, he/she needs to confirm with the juvenile what can be disclosed to the guardian and obtain the juvenile’s consent.
    Note: According to the Civil Code of the People’s Republic of China, minors between the ages of 16 and 18 (who have income from work and the ability to live independently) areconsidered to be "persons with full civil conduct", with rules equivalent to those for adults.

    5.2 counseling service disclaimer
    ① The limitations of psychological counseling
    The effectiveness of psychological counseling depends on the joint efforts of the counselor and the user. During this process, the user may also feel pain or disturbed by thesymptoms. Psychological counseling is a process that promotes personal spiritual growth, and the process of spiritual growth may also bring certain feelings of pain anddiscomfort. Therefore, for cases that require systematic psychological counseling and treatment, users need to be prepared in terms of time and cognition.
    Please understand that psychological counseling requires a process and cannot solve all the difficult problems you are currently facing with just one counseling service. If any service disputes or refund applications arise on this basis, we and the counselor will not be responsible.

    ② Psychological crisis
    If a user has a tendency to commit suicide or harm others before counseling on this platform, the counselor will do their best to help, but cannot guarantee that the user's impulse will immediately decrease during the psychological counseling and treatment period,nor can it guarantee that they will not have suicidal or harmful behaviors and tendencies in the future.If the user ultimately chooses to commit suicide or harm others,as a completely civil and criminal actor,the user bears all responsibility and consequences of the behavior,and this platform and the counselor do not bear any joint civil or criminal liability.
    If users have suicidal or harmful tendencies and behaviors when counseling on this platform,we or the counselor will contact the enterprise user you are in to fulfill the obligation of notification.After fulfilling the obligation of notification,we and the counselor will not assume any other responsibility.we and the counselor will not be responsible for the consequences caused by the user's concealment of diagnosis and symptoms.

    ③ Recommended medical treatment exemption
    This platform and counselors cannot engage in the diagnosis or treatment of mental disorders. After the full evaluation by the counselor, for users whose symptoms are notwithin the scope of psychological counseling, the counselor will promptly recommend referrals to relevant hospitals for diagnosis and medical treatment. The counselor cancontinue to provide you with psychological counseling services only if you follow the instructions for medication or treatment. At the same time, please truthfully inform yourcounselor of the diagnosis of mental health or mental diseases made in professional medical institutions, so that the counselor can better understand you and you may obtainbetter counseling results.
    The platform and counselor will not be liable for any medical disputes arising from the user's medical treatment.

    ④Dispute complaint handling
    During the psychological counseling process,if you believe that the counselor's words and deeds violate professional ethics and do not comply with the general regulations ofthe service industry, you can send the email to daxin@guanaitong.com to complain. However, it is strictly prohibited to use defamatory language or initiate personal attacksagainst counselors. If it happens, we will investigate such violations and review its legal responsibilities.
    If the effectiveness of the counseling is affected due to the intentional concealment or provision of misinformation by the user, neither we nor the counselor will bear anyresponsibility.

    5.3 Instructions for users when using in the moment care
    In the moment care is a form of psychological counseling, and the above instructions and disclaimers apply to in the moment care. In addition, when using in the moment care,please be aware of the following instructions:

    ① In the moment care is a convenient and fast mental health service. When you experience emotions and have nowhere to express them, or when you are facing pressure or distress,you can receive support and help from professional psychological counselors without waiting.

    ② In the moment care is different from regular psychological counseling services. It is usually a one-session counseling relationship. The instant counselor is not a permanentrelationship, and the counselor may be different for each session.

    ③ Settings for in the moment care
    a. Duration: Generally, in the moment care lasts for 50 minutes each time.
    b. Frequency setting: The total frequency of in the moment care and appointment counseling is once per natural week. If you use in the moment care this week, you will not beable to make an appointment for counseling that week, and vice versa.
    c. Service time: 10:00 -17:00 on Weekdays.
    d. Environmental settings: Please start counseling in a quiet and private environment, which will be more conducive to protecting your privacy and ensuring the effectiveness ofcounseling. If the environment you are in seriously affects the effectiveness of the counseling, the counselor will suggest choosing a more suitable environment and time forthe counseling.
    e. Available Sessions: in the moment care will be included in the usage of your CIIC EAP Services. If your CIIC EAP Services has a limit on the number of times, the number oftimes you use the counseling will be deducted if the in the moment care is the same as the appointment counseling.

    ④ We recommend that you make an appointment for structured counseling services in order to obtain greater benefits from the counseling, if:
    a. You have established a fixed counseling relationship with a certain counselor
    b. You hope to have an in-depth discussion with the counselor on a certain topic, such as depression recovery, adolescent-related issues, etc.
    c. If the counselor evaluates that you need more structured counseling, the counselor will seek your consent when necessary to make an appointment for structured counseling

    ⑤ This service will be provided in strict accordance with relevant national laws and regulations. At the same time, your call may be recorded to ensure the quality ofservice.

    5.4 Instructions for users when using text counseling
    Text counseling is a form of psychological counseling. The above instructions and disclaimers of counseling services for users also apply to text counseling. In addition,please be aware of the following instructions when using text counseling:
    ① Text counseling, as one of the forms of online counseling services, is a text-based psychological counseling in which the client and the counselor conduct one-to-onecommunication and dialogue.
    If you are not used to telephone/video/face-to-face counseling, or are affected by external conditions, you may consider trying the text counseling first. Since the capacity ofinformation that text counseling carries is relatively few, the efficiency is limited. For example, in text communication, you may spend 5 minutes sorting out a paragraph oftext, and the counselor may also spend 5 minutes reading the paragraph and giving you a reply. At the same time, due to the loss of information such as voice, tone, bodyposture, etc., the outcome of a single session of counseling through telephone/video/face-to-face is generally better than text counseling.

    ② Settings for text counseling
    a. Duration: The duration of text counseling is no more than 50 minutes per session.
    b. Service time: 10:00-17:00 on weekdays.
    c. Package Setting: Text counseling session will be counted as a session under your Lyra Services. If your package has a limited number of sessions, text counseling works thesame way as telephone/video/face-to-face counseling. The number of your counseling times will be deducted.

    ③ We recommend that you make an appointment for a structured counseling service in order to gain better experience from the counseling. if:
    a. You have already established a stable counseling relationship with a particular therapist.
    b. You would like to have an in-depth conversation with the counselor on particular topics, such as recovery from depression and other mental health issues, or dealing withadolescent-related issues.

    ④ We will contact you immediately by phone when you have a risks of harming yourself or others. So please keep your phone unimpeded. Also, if there is an emergency, we have theresponsibility to contact your emergency contact or the company you work for to ensure your safety.

    5.5 Disclaimers when using other counseling services
    When making physiological, legal, and financial counseling appointment on this platform, we only provide knowledge popularization or interpretation in related fields, andphysiological counseling does not provide services such as medical diagnosis and treatment, prescription and other services, legal counseling does not provide services such aswriting or reviewing legal documents, legal proceedings, etc., and financial counseling does not provide services such as financial product recommendation.
    Users have the right to make their own decisions, and the decisions made in medical, legal, and financial matters have nothing to do with this platform's counseling services,and we are not responsible for the adverse results caused by the user's independent decisions.

    6. Services change, interruption and termination
    6.1 Update
    ① In order to improve the user experience and perfect the service system, this platform will continuously strive to develop new services or contents and provide updates to users from time to time.
    ② In view of the particularity of internet services, in order to ensure the security and consistency of services, we have the right to update without special notice to users, or to change or restrict some functional effects.

    6.2 Service interruption or termination
    If any of the following situations occur, we have the right to terminate this agreement and terminate all services of the user:
    ① Enterprise user stops purchasing services from CIIC EAP on this platform.
    ② Individual user resigns from enterprise user.
    ③ If the user violates relevant national laws and regulations or our management regulations, and infringes upon the legitimate rights and interests of others.
    ④ The user are detained or prosecuted by administrative or judicial authorities for improper behaviors on this platform.
    ⑤ The user who steals others'accounts,posts prohibited information,or defrauds others' property.
    ⑥ The user disseminates misinformation, distorts facts, and has been verified to be true.
    ⑦ The user who harasses or insults other users on the platform, causing a bad impact.
    ⑧ Other situations that violate Article 1 of this Agreement, such as registration and user behavior norms, or other situations that we deem necessary to terminate the service.
    Except for the situations mentioned in the preceding paragraph, we reserve the right to interrupt or terminate part or all of the network services at any time without prior notice to the user. we do not assume any responsibility for any losses caused to the user due to the interruption or termination of the services.

    6.3 After the service is changed, interrupted or terminated, we still have the following rights:
    ① We have the right to retain user registration data and previous behavior records.
    ② If you have any illegal behaviors or violation of the terms on this platform before the service changes, interrupts, or terminates, we can still exercise the rights stipulated in these service terms.

    7. Privacy statement
    7.1 Scope of application
    During your use of this platform, we will process your relevant personal information. The relevant collection scenarios include but are not limited to:
    ① The personal information provided according to the page prompts when you register on this platform;
    ② The personal information uploaded or generated (including your profile photo, etc.) when you use the services of this platform.
    ③ Enterprise users who have obtained the consent of individual users in advance and have fully informed individual users of the purpose, scope and use of relevant datacollection, upload or provide personal information like mobile phone numbers of organization members.
    ④ Other personal information processing scenarios are detailed in "Privacy Policy".

    7.2 Information confidentiality
    Your privacy is a fundamental concern at us.We will not publicly disclose or provide your personal information and non-public contents stored when you use the service to third parties, except for the following situations: obtaining your explicit authorization in advance; necessary to deliver the CIIC EAP Services to you or the CIIC EAP Sponsor; necessary to perform statutory duties or obligations; necessary to respond to public health emergencies or emergencies to protect the life, health and property safety of natural persons; collecting personal information from legally disclosed information; sharing with third parties to provide you with more comprehensive and high-quality products/services.

    8. Limited liability
    Except as otherwise provided by law, we are not responsible for the inability or delay of service, data loss, and system failure caused by network connection failure, equipment failure, computer, communication or other system failure, power failure, hacker attack or network attack, strike, labor dispute, riot, uprising, insufficient productivity or production materials, fire, flood, storm, explosion, war, government action, international or domestic court orders or third-party inaction.
    Regardless of whether it is foreseeable or not, and regardless of the forms of behavior, we are not responsible for indirect damages (including but not limited to loss of profits or interest and business suspension).


    9. Liability
    9.1 If we find that you have any of the following behaviors, it has the right to take "corresponding measures" in accordance with the provisions of this Agreement. You hereby undertake that we have the right to take the above behaviors, and undertake not to require us to make any compensation or require us to compensate your company for the above behaviors:
    ① You provided false registration information.
    ② You violate the usage rules stipulated in this agreement.
    ③ Using our products and services or participating in activities on this platform through illegal, improper, or other unfair means.
    ④ There are behaviors that harm the legitimate interests of this platform.
    ⑤ Behavior that seriously damages other users.
    ⑥ Acts or remarks that violate the laws and regulations of the People's Republic of China.
    ⑦There are behaviors that violate social customs,social morals,and general morals and etiquette on the Internet.
    ⑧Other serious improper behaviors that hinder the provision of services by this platform or we consider seriously improper.

    If the same user engages in any of the above behaviors,we have the right to take measures against all accounts under the user,and the"corresponding measures"taken include but are not limited to one or more of the following:
    ①Modify,delete,or block related content.
    ②Warn or mute the accounts.
    ③Change,restrict or prohibit some or all functions of the account.
    ④Suspend,restrict or terminate the user's right to use this platform service, cancel user account, etc.
    ⑤ Report to relevant regulatory authorities or national agencies.
    ⑥ Other measures deemed reasonable by third parties who have suffered losses.

    9.2 You agree to protect and maintain the interests of this platform and other users. If you violate any relevant laws, regulations, or any provisions of this agreement and cause losses to this platform or any other third parties, you agree to bear the liability for any damages caused thereby.

    10. Amendment to terms of service
    10.1 By using the platform, the user is deemed to have read and agreed to be bound by this agreement. We have the right to modify the terms of this agreement when necessary. We may send users various rules, notices, prompts and other information about this service, or modify the contents of this agreement, in one or more ways, including but not limited to displaying them on relevant service pages, web announcements, web pages, prompts, email addresses, mobile text messages, regular mail delivery, and sending in-app messages within the account management system where users register to use this service.

    10.2 After the terms of this agreement are changed, if the user does not accept the modified agreement, the user shall stop using the services of this platform. If you continue to use the platform services, it is deemed that you have accepted the modified agreement.

    11. Dispute Resolution
    11.1 This Agreement is signed in Xuhui District, Shanghai, People's Republic of China.

    11.2 The interpretation and application of this Agreement,as well as disputes related to this Agreement,shall be handled according to the laws and regulations of the People's Republic of China with the application of any conflict of laws excluded.The people's court with jurisdiction in the place where this Agreement is signed shall have jurisdiction.

    12.Notice delivery
    All notices to you under this Agreement can be sent through web announcements,emails,mobile text messages,WeChat messages,or regular mail delivery;such notices are deemed to have been delivered to you on the date of sending.

    13.Other instructions
    13.1 These terms of service constitute the complete agreement between you and us regarding the terms of service and other related matters.Except as provided in the terms of service,no other rights are granted to the parties of the terms of service.

    13.2 If any provision of these terms of service is completely or partially invalid or unenforceable for any reason,the remaining provisions of these terms shall remain valid and binding.

    13.3 The headings in these terms of service are for convenience only and should be ignored when interpreting these terms.

    相关定义:
    个人信息:以电子或者其他方式记录的能够单独或者与其他信息结合识别特定自然人身份或反映特定自然人活动情况的各种信息,不包括匿名化处理后的信息。
    个人敏感信息:一旦泄露、非法提供或滥用可能危害人身和财产安全,极易导致个人名誉、身心健康受到损害或歧视性待遇等的个人信息。
    中智EAP企业用户:指注册、登录、使用中智EAP服务的个人或组织,包括但不限于法人(如公司、政府机构、事业单位等)、非法人组织(如合伙企业等)、个体工商户等(又称“中智EAP企业用户”、“您所在的企业用户”或“您的企业”);中智EAP企业用户可以邀请并授权个人用户成为我们的最终用户。
    个人用户/最终用户:指受中智EAP企业用户邀请使用我们服务的个人用户,以下称“您”或“最终用户”。
    匿名化处理:指通过对个人信息的技术处理,使得个人信息主体无法被识别、处理或复原的过程。个人信息经匿名化处理后所得的信息不属于个人信息。
    去标识化处理:是指个人信息经过处理,使其在不借助额外信息的情况下无法识别特定自然人的过程。
    1. 我们如何收集您的个人信息以及如何使用您的个人信息
    为了向您和中智EAP企业用户提供服务、保障服务的正常运行、改进和优化我们的服务以及保障您的帐号安全,我们将需要向您通过如下渠道收集您在注册、使用服务时主动提供、授权提供或因为使用服务而产生的个人信息:
    1.1 成为7×24小时热线用户
    当您使用7×24小时热线服务时,我们需要收集您的称呼、手机号、预约时间、咨询方式、身份、咨询议题/当前困扰,或其他您所在企业要求的信息,如工号、邮箱、身份证等信息,如果您拒绝我们收集这些信息,您将无法使用7X24小时热线进行咨询预约服务。
    1.2 注册成为“答心”平台的用户和用户登录及激活
    为创建账号及完成注册的需要,在注册账号时将通过以下三种方式:
    (1)当您自主注册答心平台账号时,以下信息:您需要根据注册页面提示填写手机号及您所在企业要求的信息,如分公司、工号、邮箱等,我们将通过您提供的手机号发送短信验证码的方式来验证您的身份是否有效。为了保证您的账户及个人信息安全,我们建议您使用经过您本人实名认证的手机号。若您发现答心平台上的注册账号并非您本人实名认证的手机号,建议您更换手机号,以免您的账号使用环境因非本人实名原因有较高安全风险。
    我们会尽最大努力保障您的个人信息安全,只以实名认证之目的获悉和使用,不会对无关方泄露或做其他任何用途。
    (2)您将授权您所在的企业用户提供以下信息:手机号或邮箱,或根据您所在的企业用户要求提供工号。在您登录及激活答心平台时,我们将根据收集到的上述信息向您的手机号或邮箱发送邀请短信或邮件,您可以选择是否接受并使用我们的服务。如果您拒绝我们采集这些信息,您将无法通过该登录方式正常享受登录后的产品及服务,为保护您的个人权益,您应立即停止尝试或进行任何后续登录、激活及使用产品或服务的行为,并请及时与企业用户联系。
    您应理解,您所在的企业用户委托我们提供答心平台及处理企业用户和该企业用户的最终用户使用答心平台服务过程中提交或产生的信息和数据,包括企业用户提交或要求最终用户提供的信息、企业用户分配给最终用户的信息,以及为完成服务需求而由最终用户提交给企业用户的信息(以下简称“受托处理的个人信息”)。企业用户是此类个人信息的处理者。我们接受企业用户的委托,根据企业用户的指示以及我们与企业用户间的协议或基于履行协议中的义务目的处理此类个人信息。并且企业用户在上传,管理,收集,处理,存储,对外提供其最终用户个人信息和委托我们处理最终用户个人信息之前,应确保已经按照相关法律法规事先获得最终用户的明确同意(对于敏感个人信息已取得单独同意),且已充分告知最终用户相关数据收集的种类、目的、范围、使用方式、保护措施、保存期限、委托我们进行处理的情况以及其他《个人信息保护法》项下个人信息处理者应当告知的事项。
    (3)你所在的企业用户可能委托我们从第三方获取您授权共享的账号信息,并在您同意本隐私政策后将您的第三方账号与您的答心平台账号绑定,使您可以通过第三方账号直接登录并使用我们的服务。我们会将依据与第三方的约定、对个人信息来源的合法性进行确认后,在符合相关法律和法规规定的前提下,使用您的这些个人信息。
    1.3 我们为您提供服务过程中产生并收集的信息
    1.3.1 基础信息
    当您使用我们的服务时,为保障您正常使用我们的服务,维护我们服务的正常运行,改进及优化我们的服务体验以及保障您的帐号安全或基于遵守法律法规规定的需求,我们会收集您下述信息。这类信息是为提供我们核心服务时必须收集的基础信息。
    1.3.2 设备信息
    根据您在使用我们服务过程中的设备型号及授予的权限,我们会收集使用我们服务的设备相关信息,包括设备型号、操作系统、唯一设备标识符、答心平台软件版本号。
    1.3.3 日志信息
    当您使用我们服务时,我们会收集您对服务使用的日志信息,包括接入网络的方式、类型和状态、网络质量数据、操作日志、服务日志信息(如您在答心平台进行搜索、查看操作的记录、服务故障信息等信息)等。
    1.3.4 咨询预约
    当您使用我们的服务预约咨询服务时,我们需要收集您的称呼、手机号、性别、所在城市以及您要求预约的详细信息(如预约时间、咨询方式和咨询主题)。如果您不提供相关信息,您将无法成功预约。另外,您在预约时还可以告知紧急联系人、以及您困扰的主要内容,以便我们根据以上信息能匹配到更适合您的咨询师,但如果您不提供这些补充信息,不会影响您使用我们的咨询预约功能。您提供的上述信息,仅限于我们或您预约的咨询师可查看,并严格进行保密。
    1.3.5 客户服务
    当咨询结束后,我们将通过页面提示或发送回访短信的方式,提醒您填写回访问卷。填写回访问卷后,我们会收集您自愿填写的年龄、工作年限、职务、级别信息以及咨询满意度,用于向您所在的企业用户反馈整体使用数据报告,请您放心,我们并不会因此披露您的个人信息及咨询情况。当您未填写回访问卷的情况下,我们可能需要通过采集手机号,向您发送填写回访问卷的短信提醒或者对您进行人工电话回访。但如果您不提供这些补充信息,不会影响您使用我们的服务。
    如果在回访过程中出现负面评价,为了方便帮助您解决问题,我们可能还会收集您与我们的沟通信息(包括文字/图片/音视频/通话记录形式)、与您的需求相关联的其他必要信息。我们收集这些信息仅是为了调查事实与帮助您解决问题,如您拒绝提供上述信息,我们可能无法向您及时反馈投诉、申诉或咨询结果。
    1.4 扩展信息
    为提升您在接受服务过程中的体验,我们在扩展服务中可能会收集和使用您的个人信息,此信息非核心服务所需的信息。如果您不提供这些个人信息,将导致您无法实现扩展服务,但不影响您对核心服务的正常使用。
    当您成功预约后,您选择通过视频咨询功能(视频通话)方式进行咨询时,我们将访问您的设备索取开启相机、麦克风的访问权限。如您拒绝提供该权限,仅会使您无法使用该功能,但不影响您正常使用其他功能。当您在使用编辑头像功能时,我们会收集您主动提供的上述图片信息,包括在必要时并征得您同意后访问您的设备。
    请您注意,通过启用上述活动的权限,您授权我们可以收集和使用相关个人信息来为您提供对应服务,您一旦关闭任一权限即代表您取消了授权,我们将不再基于对应权限继续收集和使用相关个人信息。您关闭权限的决定不会影响此前基于您的授权所进行的信息收集及使用。
    如您使用答心平台进行支付功能,您需调用“收银台”功能,您需在设置页面的付款验证设置页面主动选择您绑定的付款验证方式(例如密码验证、手机动态验证码等方式),我们需要根据您的选项,提供设置的付款密码或手机动态验证码。如您拒绝向我们提供这些信息,将无法完成订单的付款。
    在您提交的服务需要您采用现金方式自行支付时,您可以选择与我们合作的第三方支付机构(包括微信支付等支付通道,以下称“支付机构”)所提供的支付服务。我们需要将您的订单号与交易金额信息与这些支付机构共享以完成下单支付功能。在您使用支付功能时,支付机构会通过其页面收集或验证您的银行卡(含储蓄卡、信用卡)及其他支付必要信息,以实现其确认您的支付指令并完成支付,具体适用各支付机构相应的隐私政策。
    1.5为保障服务的稳定运行、功能实现,使您能够使用和享受更多的服务及功能,我们会根据服务需要使用有能力的软件开发包“SDK”来实现您的服务需求,更多我们产品中包含的第三方SDK服务请具体查阅附表《第三方共享清单》。

    2. 信息自动收集技术
    2.1 Cookie
    在您使用我们的产品/服务时,我们可能会使用Cookie和同类技术收集您的一些个人信息,包括:您访问网站的习惯、您的浏览信息、您的登录信息,Cookie和同类技术收集该类信息是为了您使用我们的产品/服务的必要、简化您重复操作的步骤(如注册、登录)、便于您查看使用历史(如查看历史咨询订单)、保护您的信息和账号安全性、提升我们的产品/服务等。
    3. 我们如何对外共享、转移和对外披露您的个人信息
    3.1 共享
    通常情况下,我们不会与任何公司、组织和个人共享您的个人信息,但以下情况除外:
    (1) 在获取明确同意的情况下共享:获得您的明确同意后,我们会与其他方共享您的个人信息。
    (2) 为订立、履行个人作为一方当事人的合同所必需。
    (3)为履行法定职责或者法定义务所必需,例如与国家安全、国防安全、与刑事侦查、起诉、审判和判决执行等直接相关的法定职责或者法定义务。我们可能会根据法律法规规定,或按政府主管部门的强制性要求,对外共享您的个人信息。
    (4)在法律法规允许的范围内,基于符合法律法规的社会公共利益,为应对突发公共卫生事件或者紧急情况下为保护自然人的生命健康和财产安全所必需。例如我们及咨询师将绝对尊重您的隐私,并对您的个人信息和咨询内容严格保密,但当您有伤害自己/他人的危险时,或在法律限定的情况下,我们或咨询师将联系您所在的企业用户,我们会尽量事先告知您。若情况危急时又很难得到本人授权同意的,我们或咨询师也可能立即采取行动。
    (5) 从合法公开披露的信息中收集个人信息的,如合法的新闻报道、政府信息公开等渠道。
    (6) 与第三方合作伙伴共享:为了向您提供更完善、优质的产品/服务,我们可能会在遵守“合法正当、最小必要、目的明确原则”的前提下,与第三方合作伙伴共享您的某些个人信息。
    · 与咨询师一起处理您的个人信息(包括您的用户昵称、手机号、预约时间、咨询方式)以提供咨询服务;
    · 根据您所在的企业用户的要求,我们会将您的咨询情况进行去标识化处理(包括您的年龄、岗位等个人特征信息)后制成企业整体数据报告,以便您所在的企业用户了解员工整体心理健康状态。
    · 基于学术研究,我们会使用您去标识化的个人信息(包括您的年龄、岗位等个人特征信息),以制作行业内的企业员工心理健康洞察报告。
    如果确有必要进行数据的跨境传输,我们会单独向您明确告知(包括数据出境的目的、接收方、使用方式与范围、使用内容、安全保障措施、安全风险等),并征得您的授权同意,我们会确保在符合法律法规关于个人信息出境要求的情况下数据接收方有充足的数据保护能力来保护您的个人信息。
    在对我们共享个人信息的合作伙伴,我们会与其签署严格的保密协定,要求他们按照我们的说明、本隐私政策以及其他任何相关的保密和安全措施来处理个人信息。更多详情请查阅附表《第三方共享清单》。如我们使用您的个人信息超出了与收集时所声明的目的,如有需要我们将在使用前再次向您告知并征得您的明示同意。
    (7) 接入第三方SDK或其他应用程序
    我们的产品中可能会包含第三方SDK或其他类似的应用程序,如您在我们平台上使用这类由第三方提供的服务时,您同意将由其直接收集和处理您的信息(如以嵌入代码、插件等形式)。目前我们产品中包含的第三方SDK服务请具体查阅附表《第三方共享清单》。前述服务商收集和处理信息等行为遵守其自身的隐私条款,而不适用于本政策。为了最大程度保障您的信息安全,我们建议您在使用任何第三方SDK类服务前先行查看其隐私条款。为保障您的合法权益,如您发现这等SDK或其他类似的应用程序存在风险时,建议您立即终止相关操作并及时与我们取得联系。
    除获取您的明示同意外,我们不会将您的个人信息转让给任何公司、组织或个人。如因合并、收购或破产清算的情形需要转移您的个人信息,我们会向您告知接收方的名称或者姓名和联系方式,要求接收您个人信息的公司、组织继续受本隐私政策的约束,如果本隐私政策中约定的个人信息的处理目的、处理方式、处理的个人信息种类发生任何改变,该公司、组织将重新向您征求授权同意。
    3.2 转让
    除获取您的明示同意外,我们不会将您的个人信息转让给任何公司、组织或个人。如因合并、收购或破产清算的情形需要转移您的个人信息,我们会向您告知接收方的名称或者姓名和联系方式,要求接收您个人信息的公司、组织继续受本隐私政策的约束,如果本隐私政策中约定的个人信息的处理目的、处理方式、处理的个人信息种类发生任何改变,该公司、组织将重新向您征求授权同意。
    3.2 公开披露
    除符合法律法规的规定进行公开披露或获得您单独同意外,我们不会公开披露您未自行公开或者其他未合法公开的个人信息。如需公开披露您的个人信息,我们会提前进行个人信息保护影响评估,并采用符合行业内标准的安全保护措施和手段保护您的个人信息安全。

    4. 我们如何存储您的个人信息
    我们会按照法律法规规定将在中华人民共和国境内收集的用户个人信息存储于中华人民共和国境内。我们仅在本隐私政策所述处理目的所必需的时限内存储您的个人信息,在超出存储期间后,我们会根据适用法律的要求删除您的个人信息或进行匿名化处理。

    5. 我们如何保护您的个人信息
    5.1 我们建立规范的制度流程,按照ISO27001及公安部三级等级保护等各类安全技术规范来保障您的个人信息安全。例如我们严格限制访问信息的人员范围,要求他们遵守保密义务,并进行审计。我们通过不断提升的技术手段加强安装在您设备端的软件的安全能力,以防止您的个人信息泄露。
    5.2 我们会采取一切合理可行的措施,确保只收集相关的个人信息,并防止信息的丢失、不当使用、未经授权访问或披露。我们将在合理的安全水平内使用各种安全保护措施以保障信息的安全。例如,我们会使用加密技术(例如,SSL/TLS)、去标识化或匿名化处理等手段来保护您的个人信息。
    5.3 在不幸发生个人信息安全事件后,我们启动应急预案,阻止安全事件扩大,并按照法律法规的要求,向您告知安全事件的相关信息、可能的影响、我们已采取或将要采取的处置措施、您可自主防范和降低风险的建议、对您的补救措施等。我们将及时将事件相关情况以邮件、信函、电话、推送通知等方式告知您。同时,我们还将按照监管部门要求,主动上报个人信息安全事件的处置情况。
    5.4 虽然我们遵守《中华人民共和国网络安全法》、《中华人民人民共和国数据安全法》和《中华人民国个人信息保护法》、ISO27001等安全标准,以保障您提供给我们的个人信息的安全性。但也请您理解,互联网环境并非百分之百安全,任何安全措施都无法做到无懈可击。我们强烈建议您采取积极措施保护个人信息的安全,包括但不限于使用复杂密码、定期修改密码、不将自己的帐号密码及相关个人信息透露给他人等。

    针对您的个人信息,您可根据适用法律法规享有相应的权利,包括:查阅、复制、更正、删除或转移您的个人信息或数据。
    6.1 查阅、复制您的个人信息
    您有权访问、复制您的个人信息,法律法规规定的例外情况除外。您知晓并同意,如果您想行使数据访问权,可以通过以下方式自行访问:
    账户信息—如果您希望访问您的账户中的个人资料信息和订单信息、添加紧急联系人等,您可以登录答心平台,通过访问“我的→设置”执行此类操作。
    订单信息—您可以进入答心平台后在“我的→我的订单”中访问您待付款、待咨询、待确认、已咨询、已取消、待评价的订单信息,我们会记录您以往咨询的咨询师、时间、方式。
    如果您无法通过上述链接访问这些个人信息,您可以联系我们的邮箱daxin@guanaitong.com,我们将在1个工作日内回复您的访问请求。
    6.2 更正您的个人信息
    当您发现我们处理的关于您的个人信息有错误时,您有权要求我们做出更正。您可以通过访问“6.1查阅、复制您的个人信息”中罗列的方式提出更正申请。
    如果您无法通过上述链接更正这些个人信息,您可以联系我们的邮箱daxin@guanaitong.com要求更正,我们将在1个工作日内回复您的更正请求。
    6.3 改变您授权同意的范围
    您可以通过删除信息、关闭设备功能、进行隐私设置等方式改变您授权我们继续收集个人信息的范围或撤回您的授权。您也可以通过注销账号的方式(具体操作方式详见6.5个人信息主体注销账户),撤回我们继续收集您个人信息的全部授权。

    (3)如果我们处理个人信息的行为违反了与您的约定;
    (4)如果您不再使用我们的产品或服务,或您注销了账号;
    (5)如果我们不再为您提供产品或服务。
    若您已从提供中智EAP服务的企业离职,请联系我们的邮箱daxin@guanaitong.com来删除您的账号,您产生的订单信息将会去标识化保存,我们将在合理期间内删除或匿名化处理您在该企业的相关个人信息。
    6.5 个人信息主体注销账户
    您随时可注销此前注册的账户,您可以通过以下方式自行操作:
    如您需要注销个人信息,您可以通过向我们的邮箱daxin@guanaitong.com发送邮件。一般情况下,我们将在1个工作日内回复处理。
    注销账户之后,我们将停止为您提供产品或服务,并依据您的要求,删除您的个人信息,法律法规或行业规范准则另有规定的除外。
    6.6 个人信息主体获取个人信息副本
    您有权获取您的个人信息副本,您可以通过以下方式操作:

    根据您的要求,在技术可行且符合国家网信部门规定条件的情况下,使用数据接口匹配的方式,直接将您的个人信息副本传输给您指定的第三方。

    7. 未成年人保护
    7.1未成年人使用我们的产品/服务前应取得其监护人的同意。如您为未成年人,在使用我们的产品/服务前,应在监护人监护、指导下共同阅读本隐私政策,且应在监护人明确同意和指导下使用我们的产品/服务、提交个人信息。我们根据国家相关法律法规的规定保护未成年人的个人信息。
    7.2我们不会主动直接向未成年人收集其个人信息。对于经监护人同意而收集未成年人个人信息的情况,我们只会在法律法规允许、监护人明确同意或者保护未成年人所必要的情况下收集、使用、共享、转让或公开披露此信息。
    7.3 对于可能涉及的不满14周岁的儿童个人信息,我们进一步采取以下措施予以保障:
    (1)对于收集到的儿童个人信息,我们除遵守本隐私政策关于用户个人信息的约定外,还会秉持正当必要、知情同意、目的明确、安全保障、依法利用的原则,严格遵循《儿童个人信息网络保护规定》等法律法规的要求进行存储、使用、披露,且不会超过实现收集、使用目的所必须的期限,到期后我们会对儿童个人信息进行删除或匿名化处理。我们会指定专人负责儿童个人信息保护事宜,并制定儿童个人信息保护的内部专门制度。

    CIIC Guanaitong (hereinafter referred to as "We") places a high priority on protecting your privacy and personal information, implementing appropriate security measures asrequired by the laws and regulations of the People’s Republic of China. This Privacy Policy describes our policies with respect to the personal information we collect when youuse the services offered by CIIC EAP through our ”Daxin” platform, through our telephone system, including meeting with a Provider (together, the “CIIC EAP Services”). Throughthis Privacy Policy we will explain about how we collect, use, store, share, and transfer this information when you use the CIIC EAP Services, and the ways in which we provideyou with the ability to access, update, delete and protect this information. We may revise this Privacy Policy from time to time based on laws, regulations, or businessstrategy. When this Privacy Policy is changed, we will send you a notification identifying the changed contents after the version is updated.

    This Privacy Policy applies to the CIIC EAP Services you use. We hope that you will carefully read the Privacy Policy and use relevant products and/or services after confirmingthat you fully understand and fully agree to it. If you have any questions or comments about the content of this policy, you can contact us through the various contactinformation we provide.

    Definitions
    Personal information: all kinds of information recorded by electronic or other means that can identify the identity of a specific natural person or reflect the activities of aspecific natural person, either alone or in combination with other information, excluding information processed by anonymization.
    Personal sensitive information: personal information that once leaked, illegally provided, or abused, may endanger personal and property safety, and easily lead to damage tousers’ reputation, and physical or mental health.
    CIIC EAP Sponsor: refer to individuals or organizations who register, log in, and use this product and service(include Hotline service), including but not limited to legalpersons (such as companies, government entities, public institutions, etc.), non-legal entities (such as partnerships, etc.), individual industrial and commercial households,etc. (also known as "CIIC EAP Sponsor", "the enterprise user you have joined", or "your enterprise"); Enterprise users can invite and authorize individual users to become ourend-users.
    Individual User/End user: refers to individual users invited by enterprise users to register and use the CIIC EAP service, hereinafter referred to as "you" or "individualuser".
    Anonymization: refers to the process of technical processing of personal information so that the subject of personal information cannot be identified, processed or restored.The information obtained after anonymization is no longer personal information.
    De-identification processing: refers to the process by which personal information is processed so that it cannot identify a specific natural person without the help ofadditional information.

    1 Personal Information we collect and how we use your Personal Information
    To provide services to you and enterprise users, ensure the normal operation of services, enhance and optimize our services, and secure your account, we will need to collectpersonal information that you actively provide, authorize to provide, or generate due to the use of services:
    1. Become a 7*24 hotline user
    When you use the 7*24hr hotline service, we need to collect your nickname, your mobile phone number, your expected counseling time and counseling method, your identity, yourcounseling topic/current distress or other information required by your enterprise such as employee number, email address, national identity number, etc.If you refuse us to collect such information, you will not be able to use the 7*24 hotline for counseling reservation service.

    1.2 Register as a “Daxin” user and user login and activation
    (1) When you register a Daxin account independently, you need to provide us with your mobile phone number and the information required by your companyaccording to the prompts on the registration page, such as branch office, employee number, email address, etc. We will verify whether your identity is valid by sending an SMSverification code.To ensure the security of your account and personal information, we recommend that you use a mobile phone number that has been authenticated by your real name.If you find that the information in your registered account on Daxin is not your real name authenticated mobile phone number, we suggest that you change the mobile phone numberto avoid high-security risks due to using your account in an environment where the name is not your real name.
    We will do our best to protect the security of your personal information. Your personal information is only for real-name authentication, and we will not disclose it tounrelated parties or use it for any other purposes.
    (2) You will authorize your enterprise to provide the following information: mobile phone number or email address or provide employee number required by yourcompany. When you log in and activate this platform, we will send an invitation text message or email to your mobile phone number or email according to the above informationcollected. You can choose whether to accept and use our service. If you refuse us to collect such information, you will not be able to use our services. In order to protectyour personal rights, you should immediately stop trying or conducting any subsequent login, activation and use of our services, and please contact your enterprise in a timely manner.
    You should understand that your enterprise entrusts us to provide this platform and process the information and data submitted or generated by your enterprise and you in theprocess of using this platform, including the information submitted or required by your enterprise to you, the information allocated by your enterprise to you, and theinformation submitted by you to your enterprise to meet the service needs(hereinafter referred to as "entrusted personal information").CIIC EAP Sponsors are the processors of such personal information. We accept the entrustment of CIIC EAP Sponsors to process such personal information in accordance with the instructions of CIIC EAP Sponsors and the agreement between us and CIIC EAP Sponsors or for the purpose of fulfilling our obligations under the agreement. Before uploading, managing, collecting, processing, storing, providing your personal information to outside and entrusting us to process your personal information, your enterprise shall ensure that they have obtained the explicit consent of you in advance in accordance with relevant laws and regulations (separate consent has been obtained for sensitive personal information), and have fully informed you the type, purpose, scope, mode of use, protection measures, storage period, entrusted us for processing, and other matters that personal information processors should inform under the Personal Information Protection Law of the People's Republic of China.
    (3) Your enterprise may entrust us to obtain the account information you authorize to share from a third party, and bind your third-party account to your Daxin platform account after you agree to this privacy policy, so that you can directly log in and use our services through a third-party account. We will use your personal information in accordance with the agreement with a third party and after confirming the legitimacy of the source of personal information, on the premise of complying with relevant laws and regulations.
    1.3 Information generated and collected during the process of providing services to you
    1.3.1 Basic information
    When you use our services, to ensure your normal use of our services, maintain the normal operation of our services, improve and optimize our service experience, and ensure thesecurity of your account, or to ensure compliance with laws and regulations, we will collect the following information from you. This type of information is the basicinformation that must be collected to provide our core services.

    1.3.2 Device information:
    Based on the device model and permissions granted during the installation and use of our services, we will collect information related to the device using the CIIC EAP service,including device model, operating system, unique Device ID, Daxin software version number.

    1.3.3 Log information:
    When you use our service, we will collect log information about your use of the service, including the way, type, and status of accessing the network, network quality data,operation log, and service log information (such as your search and viewing operation records in the Daxin platform, service failure information, referral website information,etc.).

    1.3.4 Counseling appointment
    When you use the Daxin platform to make an appointment for psychological counseling services, we need to collect your user nickname, mobile phone number, and the details ofyour requested appointment (such as appointment time, counseling method and counseling topic). If you do not provide the required information, you will not be able tosuccessfully make an appointment. In addition, you can also share with us your gender, city, emergency contact, and the main reason for seeking our services when making anappointment, so that we can match a more suitable counselor based on the above information. However, if you do not provide this supplementary information, it will not affectyour use of the counseling appointment function. The above information you provide is only available to us or the counselor you book an appointment with, and we are responsiblefor keeping it confidential.

    1.3.5 Client service
    After the counseling is over, we will remind you to fill out the follow-up questionnaire through page prompts or by sending follow-up text messages. After you fill out thefollow-up questionnaire, we will give you the option to share your age, work experience, position, level information, and counseling satisfaction information, which will beused for feedback on the overall usage data report to your enterprise users. Please rest assured that we will not disclose your personal information and counseling situation toyour enterprise user. If you do not fill out the follow-up questionnaire, we may need to use your mobile phone number to send you a text message reminder for filling out thefollow-up questionnaire or conduct a manual telephone follow-up. However, if you do not provide this supplementary information, it will not affect your use of our services.
    If there are negative comments during the follow-up process, to facilitate helping you solve the problem, we may also collect communication information between you and us(including text/image/audio & video/call records) and other necessary information related to your needs. We collect this information only to investigate the facts and help yousolve the problem. If you refuse to provide the above information, we may not be able to provide you with timely feedback on complaints, appeals, or counseling results.

    1.4 Expand information
    To improve your experience in the process of receiving services, we may collect and use your personal information in the extended service, which is not required for the coreservice. If you do not provide this personal information, it will cause you to be unable to use the extended service, but it will not affect your normal use of the coreservice.
    When you successfully make an appointment and choose to use the video counseling function (video call), we will access your device and request access to the camera andmicrophone. If you refuse to provide this permission, it will prevent you accessing our services through a video call, but will not affect your use of other services. When youuse the editing profile photo function, we will collect the image information you voluntarily provide, including access to your device as necessary and with your consent.
    Please note that by enabling the permissions for the above referenced activities, you authorize us to collect and use relevant personal information to provide you withcorresponding services. Once you disable any permission, it means you canceled the authorization, and we will no longer collect and use relevant personal information for suchservice. Your decision to disable the permission will not affect the information collection and use based on your previous authorization.
    If you use the Daxin platform for payment function, the "cashier" function will be used. You need to actively select the payment verification method you bind(such as passwordverification, mobile phone dynamic verification code, etc.)on the payment verification setting page of the setting page. We will provide the set payment password or mobilephone dynamic verification code according to your options. If you refuse to provide us with this information, you will not be able to complete the payment of the order.
    When the service you submit requires you to pay by yourself in cash, you can choose the payment services provided by third-party payment institutions(including paymentchannels such as WeChat payment, hereinafter referred to as "Payment institutions")that cooperate with us. We need to share your order number and transaction amountinformation with these payment institutions to complete the order payment function. When you use the payment function, the payment institution will collect or verify your bankcard(including savings card, credit card)and other necessary payment information through its page to confirm your payment instructions and complete the payment, which isspecifically applicable to the corresponding privacy policies of each payment institution.

    1.5 To ensure the stable operation and function realization of the service and enable you to use and enjoy more services and functions, we will use capable software developmentkids ("SDKs") to meet your service needs according to service needs. For more third-party SDK services included in our products, please referto the attached table "Third-Party Sharing List".

    2 Automatic information collection technology
    2.1 Cookies
    When you use our products/services, we may use cookies and similar technologies to collect some of your personal information, including your habits of visiting the website,your browsing information, and your login information. Cookies and similar technologies' collecting such information for you is necessary to use our products/services. It cansimplify the steps of your repeated operations (such as registration and login), facilitate your viewing of usage history (such as video viewing history), protect yourinformation and account security, improve our products/services, etc.

    3 How we share, transfer, and publicize your personal information to external parties

    3.1 Share
    Generally, we will not share your personal information with any company, organization, or individual, except in the following cases:

    (1) Sharing with affirmative consent: After obtaining your affirmative consent, we will share your personal information with other parties.

    (2) Necessary for the conclusion and performance of a contract to which an individual is a party.

    (3) Necessary to fulfill legal duties or obligations, such as those directly related to national security, national defense security, criminal investigation, prosecution,trial, and judgment enforcement. We may share your personal information with external parties according to the laws and regulations or mandatory requirements of the governmentand competent authorities.

    (4) Within the scope permitted by laws and regulations, based on the social public interest that complies with laws and regulations, if it is necessary to respond to publichealth emergencies or to protect the life, health, and property safety of natural persons in emergencies. We and our counselors will absolutely respect your privacy andstrictly keep your personal information and counseling content confidential. However, for example, when you are in danger of harming yourself/others or in situations limited bylaw, we or our counselors will contact the enterprise user where you are located, and we will try our best to inform you in advance. If the situation is critical and it isdifficult to obtain your authorization and consent, we or our counselors may also take immediate action.

    (5) Collecting personal information from legally disclosed information, such as legal news report, government information disclosure, etc.

    (6) Sharing with third-party partners: To provide you with more complete and high-quality products/services, we may share some of your personal information with third-partypartners under the premise of complying with the principles of "legality, minimum necessity, and clear purpose".
    ·With the counselor to process your personal information (including your user nickname, mobile phone number, appointment time, and counseling method) to provide counselingservices.
    ·According to the requirements of your CIIC EAP Sponsor, we will de-identify your counseling situation (including your age, position, and other personal characteristicinformation) and make a company-wide data report, so that your CIIC EAP Sponsor can understand the overall mental health status of its employees.
    ·For academic research, we will use your de-identified personal information (including your age, position, and other personal characteristic information) to produce a blue bookon employee mental health in the industry.
    If it is necessary to transfer data across borders, we will inform you separately (including the purpose of data export, recipient, usage and scope, usage content, securitymeasures, security risks, etc.), and obtain your authorization and consent. We will make sure that the recipient of the data has sufficient data protection capabilities toprotect your personal information in compliance with the laws and regulations on the requirements for the export of personal information.
    We will sign strict confidentiality agreements with our partners with whom we will share personal information, requiring them to handle personal information in accordance withour instructions, this Privacy Policy, and any other relevant confidentiality and security measures. For more details, please refer to the attached table "Third-Party SharingList". If we use your personal information beyond the purpose stated at the time of collection, we will inform you again and obtain your express consent if necessary before theuse.

    (7) Access to third-party SDKs or other applications
    Our products may contain third-party SDKs or other similar applications. When you use such services provided by third parties on our platform, you agree that they will directlycollect and process your information (such as in the forms of embedded codes, plugins, etc.). Please refer to the attached table for the third-partySDK services currently included in our product "Third-Party Sharing List". The collection and processing of information by the aforementioned service providerscomply with their own privacy terms and do not apply to this policy. In order to maximize the protection of your information security, we recommend that you review the privacyterms of any third-party SDK services before using them. To protect your legitimate rights and interests, if you find that such SDKs or other similarapplications pose risks, we recommend that you immediately terminate the relevant operations and contact us promptly.

    3.2 Transfer
    Except with your express consent, we will not transfer your personal information to any company, organization, or individual. If it is necessary to transfer your personalinformation due to merger, acquisition, or bankruptcy liquidation, we will inform you of the name and contact information of the recipient, and require the company ororganization that receives your personal information to continue to be bound by this Privacy Policy. If there are any changes in the purpose of processing personal information,processing method, or type of personal information to be processed as agreed in this Privacy Policy, the company or organization will seek your authorization again.

    3.3 Public disclosure
    Except for public disclosure in accordance with laws and regulations or with your separate consent, we will not publicly disclose personal information that you have notdisclosed on your own or that has not been legally disclosed. If it is necessary to publicly disclose your personal information, we will conduct a Data Protection ImpactAssessment in advance and adopt security measures and means that comply with industry standards to protect the security of your personal information.

    4 How we store your personal information
    We will store personal information collected within the territory of the People's Republic of China in accordance with local laws and regulations.
    We store your personal information only for the shortest period necessary to achieve processing purposes, and beyond that period, we delete or anonymize your personalinformation as required by applicable law.

    5 How we protect your personal information
    5.1 We establish standardized system processes and comply with various security technical specifications such as ISO27001 and Level 3 protection by the Ministry of PublicSecurity for the People’s Republic of China. For example, we strictly limit the scope of our personnel’s access to information and we require them to comply withconfidentiality obligations and conduct audits. We strengthen the security capabilities of the software installed on your device by continuously improving technical means toprevent the leakage of your personal information.

    5.2 We will take all reasonable and feasible measures to ensure that we only collect relevant personal information and to prevent the loss, improper use, unauthorized access,or disclosure of information. We will use various security measures within a reasonable level of security to ensure the security of information. For example, we will useencryption technology (such as SSL /TLS), de-identification or anonymization processing, and other means to protect your personal information.

    5.3 In the unfortunate event that a breach of personal information occurs, we will activate the emergency plan to prevent the expansion of the security incident, and inaccordance with the requirements of laws and regulations, we will inform you of the relevant information of the breach, the possible impact of the breach to your information,the disposal measures we have taken or will take, the steps you can take to prevent and reduce risk as a result of the breach, and any remedial measures that may be necessaryfor you to take. We will inform you of the relevant situation of the breach by email, letter, phone, push notification, or other communication too. At the same time, we willalso comply with local law in reporting the disposal of personal information breaches to regulatory authorities.

    6.1 Access and copy your personal information
    You have the right to access and copy your personal information, except as provided by laws and regulations. You know and agree that if you want to exercise the right of accessto data, you can access it by yourself in the following ways:
    Account information - If you wish to access your account's personal profile information and order information, add emergency contacts, etc.,you can log in to Daxin and perform such operations by accessing "My → Settings".
    Order Information - You can access your order information for pending counseling, pending confirmation, counseling, cancellation, and evaluation in "My → MyOrders" after logging in to Daxin. We will record the counselor, time, and method of your previous counseling.
    If you are unable to access this personal information through the above link, you can contact your enterprise user or contact us at daxin@guanaitong.com. We will reply to youraccess request within 1 working day.

    6.2 Correction of your personal information
    When you find that there are errors in the personal information we process about you, you have the right to request us to make corrections. You can apply for correction throughthe methods listed in " (1) Accessing your personal account info". If you are unable to correct this personal information through the above link, you can email us atdaxin@guanaitong.com or contact your enterprise user. We will reply to your correction request within 1 working days.

    6.3 Change the scope of your authorization
    You can change the scope of your authorization for us to continue collecting personal information or withdraw your authorization by deleting information, turning off devicefunctions, and reviewing your privacy settings. You can also withdraw all authorizations for us to continue collecting your personal information by canceling your account (see(6.5) personal information subject cancellation, account for specific operation methods).
    Please understand that each business function requires some basic personal information to be completed. After you withdraw your consent or authorization, we cannot continue toprovide you with the services corresponding to the withdrawal of consent or authorization, nor will we process your corresponding personal information. However, your decisionto withdraw your consent or authorization will not affect personal information processing based on your previous authorization.

    6.4 Delete your personal information
    In the following cases, you can request us to delete your personal information by contacting us at daxin@guanaitong.com or your enterprise user:
    (1) If our process of personal information violates laws and regulations.
    (2) If we collect and use your personal information without your consent.
    (3) If our process of personal information violates our agreement with you.
    (4) If you no longer use our products or services, or you cancel your account.
    (5) If we no longer provide you with products or services.
    If you are already a resigned employee, please contact us by daxin@guanaitong.com to delete your account. The order information you generate will bede-identified and saved. We will delete or anonymize your relevant personal information in the enterprise within a reasonable period.

    6.5 Cancellation of personal information subject account
    You can cancel your previously registered account at any time by following these steps:
    (1)Contact your enterprise users to request account cancellation.
    (2)If you need to delete your personal information, you can email us at daxin@guanaitong.com. Normally, we will apply to your request within 1 working days.
    After canceling the account, we will stop providing you with products or services, and delete your personal information according to your request, except as otherwise limitedby laws, regulations, or industry norms.

    6.6 Obtaining a copy of personal information by the subject of personal information
    You have the right to obtain a copy of your personal information by:

    Where technically feasible and subject to the conditions stipulated by the Cyberspace Administration of China, like data interface matching, we may also directly transmit acopy of your personal information to a third party designated by you at your request.

    7 Juvenile protection
    7.1 Juveniles shall obtain the consent of the guardian before using our products/services. If you are a juvenile, you should read this Privacy Policy under the supervision andguidance of your guardian before using our products/services, and use our products/services and submit personal information under the affirmative consent and guidance of yourguardian. We protect the personal information of juveniles in accordance with relevant national laws and regulations.

    7.2 We will not actively collect personal information from juveniles directly.
